Congratulations to all who got their approvals in Sept.
I really need your advise , it seems my case is frozen and no one is looking at it.
My priority date is Aug , 2003 ,
And RD = Jun 17 2007
and ND = Jun 18 2098
My dates were within processing dates for 3 months in 2007, 9 months in 2008 and 3+ months in 2009 but still no one is adjudicating my case.
I tried following
- Enquiry thru Aila
- Service request their toll free number.
- Enquiry thru office of local senator
- Enquiry thru Ombudusman's office.
- Enquiry using info pass
All of these enquiries just send very standard formatted response suggesting we are working on your case get back in 6 months.
Any suggestions?

I think this bill is dead. All the below events are closing up events of the PROJECT CIR. You cannot just let a project die. You need some documents to support your decisions if at all you need to debate on this in future.

don't join IV just to declare your GC.
u leeched here and never contributed and now joining to tell everyone that u have GC now. Get lost.
I would not like to use such words like Leech without knowing the history of a member. It is derogatory.
I am happy that the person joined IV and maybe contributed to it. It is partly our fault that we all did not reach out to such people and convince them enough how they can be a part of the effort. Such members with few posts may be still thinking of IV just as forum for posting their case questions. They may think of IV just like any other tracker site or forum. If it is true then it is also a fault of each one of us because we have not raised the awareness enough. It does not really matter if they post 100 times or 1 time. There are some donors who have less than 10 posts but they have been silent supporters of IV as donors for a long time. Some such people have visited local lawmakers regularly and given feedback of their meetings to IV. Some volunteer their time to IV on regular basis. So its all not about money. They just do not have time to regularly visit IV. But they support the effort one way or another in behind the scenes work or contributing to it.
What I do not like are people who do not care about what we do even though they know about IV. Such people maybe having 1000 posts or no posts. They only contact IV when their own case is having problems. Whether it is EAD delays or I485 denial etc. They could be talking against IV all this time and then suddenly expect IV to devote its time and resources to help them. It is the quality of the community that defines who we are and when we come across such people it is shameful. Last year there was a very active member for several years (never contributed a penny but had 100s of posts) who became current. He used to post on approval thread like this one seeing who gets approval. When his anxiety level reached high, he sent me a PM saying he will contribute $25 to IV if IV can help as his case is current and USCIS is not taking action. Such are the incidents we come across and we really wonder if these are the highly educated folks we are fighting for. As I have said, the reason why this backlog still exists is because Immigrants stuck in the backlog are ok with it and do not care about removing it. There is no point blaming the system, if people in the system do not complain against it.

It is very clear that USCIS is yet to complete the receipt of all I-485 applications and are not in a position to give any statistics to DOL. I think then they will be busy in issuing AP / EAD based on the receipt. Considering the current work load, I think it will take at least couple of months for the USCIS to give any reasonable estimate to DOL regarding the actual demand. Till that time, I think DOL will be forced to publish the same status every month. :(
I wish USCIS can use the people worked in Backlog Elimination centers to issue EAD / AP and clear I-485 receipts and provide some meaningful figures to DOL. [I hope they do not create another July bulletin fiasco :D]

I didn't miss a zero. USCIS gets 456,000 apps per year. They can give 521,000. Which means they have extra 65,000 per year. So to clear 600,000 at the rate of 65,000 per year is about 9.2 years.

If USCIS gets 456,000 apps per year, and they can clear $521,000 per year (more than what they get), where is the question of 10 year wait? New applications don't get cleared first, they are put at the back (of course with a lot of inefficiency, and irregualrities). Wait is due to uneven distribution of apps/countries.

My lawyer told me my labor got filed yesterday.

My wife is on H4 visa with a valid I-94 (till Feb 2009) but her status will be on H1 from Oct 1st, 2007. Do we need to go for stamping before she starts working. Also who applies for SSN - Her employer and do we need to file ourselves. The employer kept the original H1. Do we need the original to apply for SSN? How soon can we apply for SSN?

You dont need to stamp your passport before you start working. Stamp is only needed to get into the US.
I think you have to go yourself and apply for SSN unless employer tells you otherwise. That's what my wife did. There are SSN offices everywhere. You can apply right away. Make sure you apply ASAP because unless you get your SSN, you cannot be paid and it takes a few days to get it. You need original documents. All of the Chicago cases have been transferred to Atlanta. If the Chicago guys want to talk to me, I�m happy to do so. They don�t have to hire me if all they want is information. As for putting names and case numbers, without that information, they won�t take the letter seriously. Also, I think that this will get the DOL to move on those cases. Almost every time I have made a specific complaint, they have responded by resolving the case right away in order to make the whole thing go away. It wouldn�t surprise me to see the same thing here.

There are lot of support and response for this thread and can Core IV team consider this to be included in their Phase 2 campaign?. It will be an added feature for our to be legal immigrant community. ^^ Bump^^
IMHO this would be great. i know i will be here supporting IV even after i get my GC. The truth of the matter is most users disappear as soon as they get their GC and stop supporting the greater cause (correct me if i'm wrong) of getting one's citizenship. I'm pretty sure we will probably see more users joining in to support this phase.
Then there are also the ones, that have the mindset that since getting the GC most of the weight is lifted off ones shoulders, and one can do pretty much (not all of course) anything that a citizen can. So the waiting for 5 years is not a burden to most. I'm not too sure if this is the case with everybody, but some that i know feel that way....

How long was your I 140 pending and what is the dob of child?
Not sure if I have given full details of my sons case but here is the situation
1. In 1998 husband moved to us on L 1 visa
2. In 2000 company filed I 140 for husband and approved 2001, within one year of I 140 approval filed I 485' for all residing in the USA at that time and concurrently file I 824 for minor child abroad - was was to follow to join-
per instructions on I 485 application
3. The child's I 824 was pending at enactment of cspa with no final determination, so should be covered under limited exception
4. Oct 2002, received letter from uscis, (did NOT say son aged out) to say file new I 824 once husband had his green card. Sons age for cspa EB3 20years 8 months
It appears the file became separated, (IN error) so son's I 824 was worked before husband's file was complete
5. Sent new I 824 when hubby got green card and this was approved Aug 04
6. As , no news from consulate/NVC by Jan 05, got congressman's help and took till Oct 05 to received an e-mail from consulate to say son aged out
Was getting paperwork ready to file law suit when husband died very suddenly. They agree with 95% of our claim but say now hubby is dead so is the case.
My attorney say's we are suing for the mistakes and so not relevant that husband has since passed, I will let you know how the case goes

Hi,
I have entered US on H4 and then I got my H1. I wanted to go to Mexico for my H1 stamping as I have to go to my home country and come back. When I saw my paystubs I found that the SSN number on my paystubs was not correct. I verified with my employer and he says it was his mistake.
Can we correct and regenrate the paystubs with correct SSN. Will these paystubs cause a problem for me during my stamping in mexico. I started working only 7 months ago and I do not have W2 till now. Please advice on how to deal with this.

Has anyone asked attorney whether we can write our case number on the complaint letter without asking employer since LC(PERM) is filed by employer and the case number seems to belong to employer.
My HR and company hired attorney are always not cooperative to my GC and I want to clear things.
Don't take my question negative. I am fully supportive this 100% and appreciate guys very much. I am happy that we are doing something to make things better.

If you read my any previous posts and to repeat, there will be no issue to contribute from me or most of us here. We need an action item. Anyone with minimum common knowledge here sees there is no change in dates for the last 6 months, or even last few years. You seem to be a strong supporter of contributions, can you list one action item which we planned to take up in the last or in near future that addresses our concerns of backlogs. Now dont come back and tell me or send me a picture of July 07 campaign or your 12th grade or 10th grade marksheet. We need to be doing things of our interest EVERY single day. I do my job very good.. I know.. but I have to keep doing it everyday if I have to keep it. Similarly unless you put continuous efforts, you wont get continuous results.
If you want a reply to your post from me again, come back with an action item that you see as planned.
