My friend came to US on January through one bodyshopper on H1B visa and he was on project for 4 months.When his project is over and he is on bench then his employer forcing him to send him a email stating that he will be on leave without pay and immediately his employer stopped paying him salary from the day he was on bench.
Can any one please guide me that how to file complaint to DOL against his body shopper.
Also i wanted to know that will DOL take any against his body shopper and what information DOL will ask as currently my friend does not wanted to confront with his employer.

Welcome to the world of USCIS!
What a crazy system..
Hi Guys,
On July 2nd I have applied for my wife (EAD, AP, I485) and have waited for 3 months (October 1st) to hear that USCIS has rejected her application due to wrong fees (But we have sent them the correct fees)
My Lawyer immediately sent back the application to USCIS saying that the Check we have sent is correct and it is before increasing the fees and we haven’t done any mistake.
In the meantime on July 16th I got my 485 approved and got my GC. So now we were worried as my wife is already out of status and don’t know how long it will take now to get her receipts and how long she can stay.
I have tried calling USCIS – Every time same answer -- you have to wait, you have to wait No records in the Database. Yesterday when I called, a Lady answered the phone and she said we need to wait 90 more days again as it is like a new Submission and it was a shock for me after hearing that.
Can any body suggest me what to do in this kind of situation? Is there any body in the same situation?

I think it is apparent that people on this forum are frustrated with media representation and lack of understanding of the problems that our group, and those that we represent, face.
Without wishing to get into general political debates, it is probably a fair assumption that American citizens who are actively part of grassroots activism would be concerned about our situation if they knew about it.
There is a voice in numbers, and I believe it might be a good idea to reach out to organizations such as www.indymedia.com (http://www.indymedia.org/en/index.shtml). This is a main hub, there are various regional versions of the organization.
Just another thought on how to publicize our issues.

Hi,
I entered us on J-1 visa, then changed my status here to F-1. I went to school only for one semester, then I had to take off because of pregnancy, and later taking care of newborn twins. So, I had been out of school for 3 semesters. But my international student advisor told me I could still come back now without having to apply for reinstatement.
I don't know how he did it, but he said he had given me some extensions.
Anyway, i would like to travel home (Europe) after next semester. I know I willl have to apply for student visa over there to ba able to come back.
But might there be a problem either with obtaining that visa or here at the airport because I had been out of school for so long and have already kids who are american citizens. Their father is US citizen too, but we can not get married right now, as he is still not divorced.

I am currently unemployed and my spouse needs to travel to Mumbai urgently. Our AP is valid through November 30, 2009. Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. I have couple of questions regarding Travel Document or Advance Parole.
My EAD has already been filed by my Lawyer but she is charging too much for filing Advance Parole or Travel Document,so here goes my questions.
- Is there a way to file for Travel Document myself, without involving the lawyer and if yes how can i do that

Yes, you will need an Advance Parole or an appropriate visa to enter the US from Canada. AP approvals are taking close to 3 months these days so you should e-file your application ASAP. Also, call USCIS at (800) 375 - 5283 to expedite your application once you have the receipt number since you need to travel at such a short notice.
Some people have had luck contacting their congress representative as well.

Hi,
I have recently recieved approval for I-140. With no surprise, employer denies to share the copy. I am planning to file FOIA to get the copy. Questions I have :
1. Can I file for FOIA even if my I-485 is not filed?
2. Reason to ask 1. is, Form G-639 requires Alien Registration Number (A#) which I believe, one can get only after filing I-485. Please correct me if I am wrong.
3. If I am right, Can I file FOIA without Alien#?

Last Status counts situation DOES NOT apply here.
That rule applies to situations where you've gone from h1b to h4 or ead etc..
In your case, you can have as many approved h1b petitions as possible since it's really petition approved for that employer and your are merely beneficiary.
BUT you can ONLY work for 1 employer at a time..
Going by your situation.. if you have approved h1 from company B and are working with company B. THEN you are okay.. to hell with what company A may choose to do..
