I have changed jobs using EAD after 1.5 years of filing I-485. Can I file for a new Eb-2 case with my new employer and port the priority date of my EB-3 case ? Thanks.

And now for some good news.....The New York Times and the St. Petersburg Times reported two separate indidents of penalties and [prison sentences imposed on people who provided fraudulent immigration services to foreign nationals.
The NYT article (http://cityroom.blogs.nytimes.com/2010/03/01/3-million-judgment-in-immigration-fraud-case/?scp=2&sq=immigration&st=cse) describes how Miriam Mercedes Hernandez was ordered to pay $3 million in fines and restitution to her victims. Ms. Hernandez charged her victim up to $15,000 per person to help them get permanent residence or citizenship within eight month but never performed the services she claimed.
As the article states
Immigration fraud, often orchestrated by immigrants, has proliferated across the country, victimizing people desperate to gain legal residency or citizenship. Law enforcement officials say such schemes are particularly difficult to uncover and prosecute because many victims are in the country illegally and are hesitant to seek help from the authorities for fear of deportation.
Under state and federal law, only lawyers or representatives accredited by the Justice Department can represent people before the immigration authorities. Anyone providing immigration services must also comply with strict rules governing contracts and advertising.
The St. Petersburg Times article (http://www.tampabay.com/news/courts/owner-of-clearwater-immigration-services-firm-gets-prison-for-false-asylum/1077161)describes a Clearwater woman who was ordered to 5 years in prison for filing false asylum claims. She was also ordered to forfeit $800,000 in profits. The defendant filed 274 asylum applications with false allegations of persecution.

I am planning to get my H1 stamped during my next trip to India and have a couple of questions
1) Have anyone used Yourmaninindia or Sahara Care or any other service to deposit H1 forms at VFS Mumbai. For Mumbai consulate, the forms need to be submitted 3 days prior to Visa Interview and they do not accept courier :mad:
2) I recently found that if you have an appointment at one of the consulates in Mexico, you can Fax the 797 and get PMIS verified in advance.
Do we need to submit the entire H1 fee for appointment ? If there is a cheaper way, I am thinking of taking an appointment , get PMIS verified and cancel the appointment.
3) Any idea if they do a PMIS verification for H1 extensions (same company) as well ?

Friend of your's needs to carefully look at that page of the passport again.
One of the following would be corssed out (or marked deleted)
(1) ECR: Emigration Check Required (for all countries except Bangladesh, Pak, North America and Europe)
(2) Emigration Check NOT Required.
If ECNR is not deleted, then there is no problem. If it is delted, there is still no problem in coming to the US (In my passport, ECNR was deleted, and I had no problem in leaving India for the US).
If ECR is not deleted, then emigration check is required only if you are travelling to countries that are not in the list of exceptions in (1).

If the employer agrees not to revoke the 140, Can I change the employer after getting EAD. 485 application is pending but less than 180 days.

My employer sent the documents for my H1b extension today to USCIS and they applied it through premium process, can anyone please let me know how many days it will take to get the Receipt notice both in Email and hardcopy?
My H1b expires on Dec 15th 2010 and if I wont get my receipt notice by than can I stay in US legally or should I have to leave US?
Please let me know your suggestion.

You will get the acknowledgment within 3 to 4 days of receipt.
If you do not get receipt, then you are out of status and will have to leave the country. But don't worry you will have the receipt before Dec 15. BTW which center did you apply to?

Just trying to understand what would that statement indicate for next/future visa bulletins. It can be deciphered in different dimensions ie:
- all visas have been allocated and all upto priority date have been allocated (second one may not be true) .. this leads to no retrogression (or) no movement in next bulltin
- all visas allocated and not all people allocated .. which may lead to retrogression in next bulletin
There are many other combination of interpretations as well.

Does this suggest that - All folks who entered on advance parole (and got 1 yr stamp on their I-94) but stayed beyond that duration because of a valid H1B / EAD are out of status?

well queen my long lost thought you were gone forever to never come back friend. I am not to familiar with the nikon lenses i would imaging the logical side would be to cover as many focal lengths as possible and that would be covered by the 18-55 and the 55-200mm lenses. however im not sure if the 18-135 lens offers supperior glass or not. If it does i would say that would be the one you go with. anyway it sure is nice to see you on here queen i must say i missed ya.
