Also one unusual acitivity of USCIS has been to suspend premium processing of I-140 for the month of July. That to me suggests that they are preparing for the deluge of I-485s.

I think the current state of disagreement is good because at least everything is out in the open and up for fighting. If this bill had to be scuttled it could have been done very quietly. But there are enough people out there who will make sure that there is no easy death for this bill. It is a fight and a lot of egos will need to appeased in the process.
How much will we gain out of it in the end as skilled legal immigrants may not be necessarily in our control during this whole process as illegal voices are more stronger and we are really considered compromisable. It will be up to our well wisher politicians and vested business interests to push something in our favor.

Perhaps we can refer USCIS to some of the rogue lawyers we deal on a daily basis. They will have to talk to the lawyer's paralegal, get an appointment to talk to the lawyer after 48 hours and get a lousy half ass written response prepared and that too a week late.

Did you apply for your 485? Your profile does not show that it has.
The date on which your 485 is filed is the order on which the applications are processed.
your PD is only used to say whether an application is eligible for processing. Once it is eligible, it is the 485 application date that states your position in the queue.
If this is true then my wait will be longer:(

Once she finished that part Politely I asked her to transfer to an IO. Luckily without any wait call got connected to an IO. Had very brief conversation with him. He was fixated on my EAD being valid till August 2010, so according to him I don't have to worry about. But I persisted with my line of questions like current status, whether it is pre-adjudicated?, whether all clearances are done etc. Only thing he replied was "Your Case is in REVIEW". I asked him what does review means. His answer was review means review. Our conversation stopped there.
What do you guys think on "Your case is under review"?

GC is a future job offer - and at the time of adjucation of 485, u must have a valid job offer. till that date u can stay in the US even without working for any employer but at the time of adjucation u must be employed in a similar position.

If your kid gets high scores in SAT but does not get into an ivy league college because your ethnicity is over-represented - but some other kid with much lower scores gets in (and its not a hypothetical scenario - happens every admission season and i sincerely hope does not happen to your loved ones).....where does that leave your logic??

For EB3 (All countries) to see some light, the changes made recently to the allocation of excess visa, spill over and also to over subscribed countries need to be revisited. Not sure, what triggered USCIS / DOS to revise the interpretation after so many years. Did IV had any role on this, or not .. do not know.. I ask this as based on all forum updates, IV appears to have little success in the Admin Fix area. I have posted this so many times in various threads and did not get an answer, may be there is none. If the interpretation was somewhat like before, EB2 /3 both would have got the spillover... and all would have benefited in the order of PD. Now with the new interpretation. all excess / spillover visa just goes only to 2 countries (EB2 India / China). Looking at the latest numbers based on USCIS website, China has far less cases compared in India based on the cut-off date, which is good for India (EB2), as they now consume a big chunk of the numbers and rest are left out for now. I am not sure, what is opinion on this from folks from ROW (EB3) on this. Does IV has any comment on this... Having said this, I have nothing against Eb2 or EB2 India specific, and not getting into the argument whether or not EB2 need to given much preference.. (Well DOS allocated on 28.6% of total numbers to both this category). This is just my concern on the changes to interpretation for the visa spill over process.

i thought same as u in that apprval has to be by 31 july, however my lawyer says i can file if approved 1 to 16 aug. confusing as heck

But in order to file concurrent 140 and 485, you have to have your labor approved. This is why people who are stuck at BEC's cannot file since they don't have their approval yet even though they filed long back. This is just my 2 cents. You can find lawyers who agree on this and disagree, it's one of the gray areas....I'm in the same situation, waiting for my PERM from Atlanta..filed in Feb. If I get my approval before Aug 17th, I plan to file.

I received an email today from USCIS requesting additional information on my case. My wife received identical email like I did.
Please let me know
1. How many days does it take for USCIS to send the letter.
2. How many days does it take for USCIS to look into my case again once I send the evidence requested.
Did anyone receive similar evidence requests. What evidence do they possibly need in this phase....

This H1B drama has really brought out the "indian" in each one of us (you). God Forbid, some of the anti-immigrant agencies see this, we will no face to fight.
To say something like what logiclife has said only brings out the true face of the some people behind immigrationvoice.org. It all boils down to "who has a US degree and who hasnt"..well, Mr logiclife, You dont know the value of a US degree simply because you dont have one! I want my GC as much as some people here without a US degree, but to classify a US degree as being the same as "warm spit" is just plain "uneducated". Now, I really appreciate all that immigrationvoice.org is doing for our community, but some of the these stupid racist comments from the so-called administartors,with such an attitude,who happen to meet the US lawmakers scares me a lot.
There are people who have done Masters in computer science in USA, graduated in 2002 and 2003 from top 50 universities and ended up getting training from desi bodyshops who we all love to hate. That training made them capable of gettting H1 and paycheck, not the books they read in US masters courses.
If US universities were up to the job of teaching people what was demanded by market, these folks wouldnt have had to go to desi bodyshops do get training.
I dont have US masters. I had enrolled in US masters degree in fall 2000. I left after 1 semester. During my brief stint as a student of Masters in Computer Science, I did get an opportunity to see what the courses are and what they really teach.
The reason I am lashing at some folks here is that some people are thinking that the Durbin-Grassley bill will benefit them because it will end consulting. Some people dont realize that most US masters degree holders, both MBA and MS (Computer science) find out that in order to get an H1, consulting is THE ONLY OPTION, especially when INTEL, Oracle and Cisco arent recruiting, they do go and stand in queue in front of consutling companies (Desi or otherwise). Also, people doing full-time jobs in silicon valley (what some people call "real jobs") also do fall back to consulting when they are laid off.
When employees of chipmaking and software development companies are laid off en masse, (and many of whom have masters degree from USA) where do they do to fall back and file H1 before the grace period expires?

To say that US masters degree holders dont need "Consulting" is the most stupid comment I have ever heard. Also, how important you are to this country or tech industry is to be decided by your boss and your employer. Not by what degrees you have in your resume. So by saying that "We have masters, we deserve better" isnt really going to jive with reality. People get masters degree mostly because its a stepping stone to H1B, just like H1B is the stepping stone to GC. Very few people do masters because they want to learn hi-tech stuff or to get better education.

I got the CPO email just now.. i'm not sure if it's because of the SR that my wife opened on Friday evening or it just happened without that.. but anyways it's a relief now.. i also see a lot of people getting cpo emails today.. btw, just curious, does the cpo stage come before "approved" status or after it?
now hope that i receive the card in time.. will post about its validity and start date once i receive it. (i'll be current for the month of September as my pd is july 06)

" and today's email says that "on August 18, 2008 we ordered...". anyways, i'm not worried about these multiple emails.. now waiting for getting the actual card in hand..
