Folks,
I got greened today, surprisingly. Could anyone let me know what are the good numbers to reach a human in USCIS, hopefully with less wait time. I wanted to check with them what address they have on file. I filed an address change in JUne but I am not sure if they have it right in their systems. Also, is there a way to get this information without calling them.

Now this is what is going to happen.
Because DOS and USCIS screwed up big time playing loosely with laws and expecting no reprisals for their actions, they will now beg/borrow for the lost visa numbers and make them available for July filers.
I see no escape route for the mess up. Rice, who did not pay any attention to this fisco gave her on the lip casual response to MSNBC reporter.
It looks like this issue is bigger than Iraq from security stand point of view and also with latest information of Al-Qaeda making statements to get into US for attacks.
I would be very surprised if they start working on cases submitted in July even if current and they get extra visa numbers. There are people like me who had submitted thier I-485s (with I-140) under EB2 back in August 2006 and were current back then. I'm still waiting.

i odn't think it passed. what was included in the amendment is s1121 and not s113 that has our provisions. please clarify.

i just looked at the amendments in detail and this provision was in SA 180 (page 1113)
On the other hand SA 187 (page 1121) seems to have passed.
I am a bit unsure though of what happened to SA 180. Did it get amended by some other amendment. It does not appear to have been tabled.

I have a slightly complicated situation. All your suggestions are welcome.
I am on H1B with 485 filed. My wife is on H4, without 485 filed. My H1B and her H4 expires around end of March. She has an approved 797 (she will either need to apply COS or go out and enter on H1B visa) and her employer will begin her H1B proceedings hopefully before end of January.
I am thinking of applying for my H1 extension next week, without applying for her H4 extension at this time. If, in the next few weeks her H1B COS is not filed, I am planning to then file her H4 renewal.
Do you see any problems with this approach? Do you have a better idea?

good point ..I do invest in stocks / ETF's and funds ...but I would definitely say ..stay away from day trading !!! be diversified, invest in good companies (invest only pocket money/minor amount in very risky assets) and for the long term ..i.e. you should not need that money during emergencies ..STAY AWAY from all day trading software !!! and if you cannot take losses (or are happy with normal returns) ...stay away from stocks (except for a small portfolio/ 401 etc) completely

Depends on lot of factors. I have been trading for last 10 years. I don't trade stocks. I trade index futures sp500 and Nasdaq mini. It is short term - couple of hours to maximum couple of days. Taxes are computed differently for futures trading. You will need this IRS form (6781 Gains and Losses From Section 1256 Contracts and Straddles) to file your taxes for trading futures.

Trading, of course, involves risks. I pick funds for my 401(k). So far it has been good. I was up last year 4.2%. Never had any losing year in 401(k).
There are many tools for technical charting. I use Ninja Trader since it allow to me define new indicators using c# (.net) language.
If anyone is interested, I put my daily charts here. Sorry, I can not disclose my indicators and I don't have anything to sell either.

The situation is the same. In my case and of course in most of others too, what he/she said is correct. Waiting for Eb3 to cross 2001 has become a difficult thing. If I started an EB2 app rather than hoping positively, I would have finished my wait for GC.
Ever since retrogression started the dates have not crossed 2001. 245i or not, the backlog is a fact. Sad part, when there is action items from IV, trying to talk to my state members, I have realized and been told that IV does not cater to EB3 anymore. It is disheartening how much ever I try to explain, occasional members look at IV threads like EB2-EB3 predictions and say there is no hope for EB3 and also IV has no answer to it.
I tried my part...too bad I was not able to participate in the IV advocacy day due to family emergency. anyway, let us hope IV's persistence yields us the results. My heart goes for a lot of EB3s who may automatically qualify for EB2 just due to their experience.

Such armchair strategy folks are the reason we are all suffering in EB3 I. If these folks joined this effort and worked hard to fix it, we would have made lot more progress. Despite being highly educated, some people fall prey to divisive posts and opinions on the forums without checking the facts.
People who had come to the DC advocacy day this month know what we do and that our focus is solving EB retrogression completely. We do not talk about EB2 , EB3 categories. We talk about the overall retrogression in EB visas.
The biggest damage and threat to this effort is not from anti-immigrants or other interest groups but from people of our own community who spread lies, pursue personal agenda and grudges, talk against this effort and cause damage to this community effort. They forget that this damages their own cause. Have you seen divisive posts, or anti-organization posts on the forums of anti-immigrants? Just think about it.
After leading this effort for more than 4 years I have come to a realization that we as a community are the reason of our own failure and the reason for our own successes. There is nobody else to be blamed. If we have to blame someone for this broken system, it is ourselves for not being able to get together and fix it.

Although IV is fighting for a niche stage in the legal immigration process, a stage which almost all non-immigrants have to pass through, it is my perspective that this is never clearly communicated. The NumbersUSA website is visually more informative.
Most probably, NumbersUSA has a much larger pool of money. Some persons believe in their cause by making contributions. They may have full-time employees and/or professional support.
Most persons stuck in EB retrogression want service at NO COST. Most others want service at negligible cost.
IV appears to be having a hard time getting contributions even they beg for it.

I would again emphasize on my previous post. One step at a time, one swift ruling for all waiting for long time in queue.
Remember, this is not 0-sum game or targeting a small group. In a queue you are closer to the target as people in front of you move.
Do get with people around you who are having same issues, organize local groups, communicate with your local authorities & media and make it an issue.

H1Bs can't get EB1C. They need to be outside country in 1 out of 3 prceeding years. EB1C is intracompany transfer visa. Even if one is on H1B, they will be need to moved to L1A before they attempt this to my knowledge. Again we are not here to fix the world., we are here to fight for our cause and get going.. Lets be clear.. Most guys after getting their Citizenship, will also vote for republicans... So to me if we can somehow through, under, around get that visa recapture, we are all back to business my friend.. It is not a separate issue. It is the issue..

No one knows dick about PD movement. EB3 filers think that somehow EB2 PD gets stuck or even retrogress and EB3 PDs race forward to 2003/2004, through some delusional logic. Those who filed under EB2 think, EB2 PD moves to 2005/2006. These predictions are mostly prejudicial. USCIS may have some idea after entering all June/July/Aug applications, that is if they can find someone who can add :D.

I booked my ticket a month ago but haven't yet figured out accommodation and travel within DC. I'm flying into DC on Sunday, 3rd morning.
Is someone looking to share a hotel room? Alternately, is any DC area member still looking to offer a spare sleeping bag? :)
I don't know how the DC area works but would preferably like to stay closer to the event hotel. If not, I'm open to renting a car and sharing cost to get in/out of DC (heard the traffic is a nightmare though).

One lady picked up and told me that my application was not reigstered and it might be in return mail..She said recently they are sending the application back if the photos come as black when scanned using their scanner. She told me to contact mail room but no luck in reaching them..Its always busy and going to voice mail..
i've sent another email about mail room contact..I've got response and asked my number and the rep will ask the mail room to contact me directly....I'm hoping to hear from them..

Why are you equating quality of life to owning a house?
- Because you are an "owner"? No you are not! You are renting the house from the bank
- Because you have a backyard?- go out and rent a house. They are a dime a dozen, will cost you half the cost of your monthly mortgage payment
- Because you have peace of mind? Really. Read your other post on people getting laid off
- Because your (ok someone else's) kid asked if you are poor? Really? A kid's innocent question is going to make you gamble (that's what investing in an immovable asset is in your situation) away a decade of savings?
- Because you want to give your child the best possible childhood? Think about it, if things turn for the worse either in your economy/company/job (absolutely do not wish it on anyone), and you are forced to move/sell the house/get foreclosed upon etc., how much more have you hurt your family and traumatized them in your effort to give them a great childhood?
- How many nights of peaceful sleep have you lost lying awake wondering what you would do if you/your spouse lost a job, had to move etc.?
I still cannot understand how/why someone would buy a house in the bay area ($700K+ for a SFH in a minimally liveable area) and $1M+ in places like Cupertino.

I have seen approvals for May filers on IV.
Lots of people have posted about their EAD approvals in the GC thread.
I think TSC have started approving EAD filed in may. So, lets hope for the best. I hope this helps.
