My wife got her approval documents yesterday. Effective H1 date on I-94 starts from Oct 2007. Anyone knows how soon can she file for SSN or does she have to wait till Oct 1st.

She obviously cannot wait till Oct 1st or she won't get paid for the first week (at least). Contact the SSN office to find out how soon you have to file. In my opinion, you are eligible to get an SSN the moment you receive work authorization (even if its for a future date).

I was wondering if any one in the core or other members think about the next step towards getting citizenship after passing the hurdles of getting the green card. If a person is here for 10 years and then get his green card (average period), then he need to wait for another 5 years to get the citizenship. 15 years for this process in a person's life is too much.
IV Core can push or lobby for a law which can make the person a US citizen, if he is living in US for 10 years legally without any issues and paying taxes for the entire period. It is just my idea.
Further to this, the eligibility criteria can also include that we should have the full social security points (40 points) and a minimum contribution of $25,000 towards social security fund.

House GOP threatens to blue-slip bill (The Hill)

    By Jonathan Allen

Lawmakers are shrouding themselves in a thin slip of blue paper as deep divisions on immigration policy are again being laid bare.

House Republicans have threatened to deliver a blue slip rejection of the Senate immigration bill, and Senate Democrats are blocking efforts to circumvent that maneuver.

The result is a procedural paralysis that has prevented the two chambers from even naming conference negotiators, a clear sign of the difficulties facing proponents of an immigration overhaul.

The Senate-written immigration bill contains tax provisions, violating the Constitutions requirement that all revenue measures originate in the House. Any House member could object to the Senate bill on that basis, forcing debate and a vote on whether to reject the measure outright.

Ways and Means Chairman Bill Thomas (R-Calif.) is considered the most likely to raise such an objection, but any number of House conservatives would be happy to kill the Senate bill. To avoid that fate, Senate Republican leaders want to bring up a separate House-passed tax bill, gut it and replace its provisions with the Senate immigration bill. But Senate Minority Leader Harry Reid (D-Nev.) has objected to that maneuver.

Reid said he is concerned that using a House-passed tax vehicle could invite the introduction of unrelated tax cuts into House-Senate conference negotiations. If President Bush wants progress on the bill, he should tell House Republicans, Dont raise the blue-slip issue, Reid said.

But Republicans say the problem is Reid, not the blue slip.

Unfortunately, the minority leader over there, Harry Reid, continues to stand in the way, House Majority Leader John Boehner (R-Ohio) said yesterday. I think he ought to quit playing politics.

As lawmakers engaged a new round of finger-pointing yesterday, one thing remained clear: The immigration bill is stuck.

Conservative Republicans are dead-set against the Senate bill, which would beef up border security, establish a temporary-worker program and allow many of the 11 million to 12 million illegal immigrants in the country now to become citizens eventually.

The House version focuses solely on border security, and many House Republicans say the Senate bill would grant amnesty to millions of immigrants who broke the law to get here.

But proponents of the Senate bill say the blue-slip threat is merely a distraction, one of a number of tools the bills critics could use to thwart its progress if they chose to do so. If the will exists to strike a deal, they say, procedural roadblocks will not be a problem.

Some technical blue slip is not going to stop any resolution that we come to, Sen. John McCain (R-Ariz.), a chief proponent of the Senate bill, said yesterday. Lets not get caught up in the minutiae and the weeds.

McCain was among the leaders of a bipartisan core of senators who struck a deal on the immigration bill and then shepherded it through the Senate last month. Sixty-two senators, most of them Democrats, voted for the final bill.

The legislation drew harsh criticism from Senate conservatives, many of whom voted against it. Even if Reid were to allow GOP leaders to move forward, there is no guarantee that Republican senators would not use procedural weapons to stop action.

Sen. Jeff Sessions (R-Ala.) tried to kill the bill on its first trip through the Senate.

Sessions sent a Dear Colleague letter yesterday in which he urged colleagues to study the details of the immigration bill, particularly the number of legal immigrants it would allow into the country in future years.

It remains deeply flawed, he wrote.

Republicans hinted yesterday that they have other options for getting around the blue-slip problem.

Theres always a Plan B, said Eric Ueland, chief of staff to Senate Majority Leader Bill Frist (R-Tenn.).

In 2000, House and Senate leaders circumvented a similar problem by appointing shadow conferees to a bankruptcy bill and attaching their work product to the conference report on a separate bill, according to Walter J. Oleszeks Congressional Procedures and the Policy Process.

But alternatives and timelines were in short supply yesterday.

Things can break loose at any time, Ueland said.

    Dear All,

First of all I am pleased to inform you that I will certainly attend the advocacy campaign. This will be my first participation. I am eager and hope to make it. I have also started making travel / stay arrangements.

Here is what I wanted to request / share with you:

    1. The advocacy related information is is "red" font. I think red font is normally used for the "donor forum".

    2. As such I was looking desperately for information aout advocacy, without trying to "click" on the available thread links, just because it is provided in red font! I then spoke to a friend of mine who told me that though this is in red font, I would be able to enter! I am sure, there could be many like me. Can you please make it obvious that "advocacy links" are not donor exclusive? This will spread the news and create better awareness. I am also planning to write mails to all my friends who are in the endless GC line

    3. I think we are expected to show up in Saturday, April 2, 2011. What time should we be present and where? This is required for flight / hotel reservation. Do we have a common meeting point? What is the exact address? Any telephone / email / contact no(s). ?

    4. Is there any dress code please?

    5. Are the participants who turn up expected to fund some amount? If so kindly let me
know ( as I wish to write to my friends about this)

    6. When will be able to leave on April 5, 2011? This is also required for the purposes of
    hotel reservation and ticket booking

    7. Are we all going to talk in one voice about Visa recapture? Or do we have other issues
    in the agenda?

    8. I work for a highly reputed international orgnaization. I have already taken the issue of the EB wait for GC with senior management and also with HR. The truth is, being born Americans, they were taken by surprise! On senior lady remarked , "Wow! Are you kidding me? 10 years minimum of a Green Card? Why don't you guys open your mouth!"

May be all this information I have asked is already available. If so, kindly give me the link. I will go through everything.

PLEASE GIVE MAXIMUM PUBLICITY TO THIS EVENT HIGHLIGHTING THAT THIS RELATES TO LEGAL IMMIGRANTS, LEGAL IMMIGRANTS, LEGAL IMMIGRANTS !!!

Sorry for the inconvenience, if any! Thanks to one and all!

Best wishes for the success of the meet! GOD Bless!

I called 4 member, the person at frontdesk didn't transfer me anywhere. Also, they knew why I am calling and they remember all three Bill Numbers by heart now.

When I said Can I leave the message then I was told we got your message Sir, and I will pass on the message to Senator.

The frontdesk staff is instructed not to transfer our calls to the right person in their office. So after calling 4 members, I stopped.

    Thanks.

Chaya, We are going back to India on personal choice. My manager here knows very clearly that I cannot take up promotions and the HR does not want to do eb3-->eb2 conversion. So, I took up this crap for a while, and decided to put an end to this misery once and for all. And fortunately the same company is offering me a job in India at a good designation with good compensation. Also, we were missing out (esp my kids) were missing out lot of things happening in India, which they want to be a part of. Original idea was to stay in US for 10 years and go, only difference is now, we did spend that 10 years but still dont have our GC. Another important thing that we considered was , it becomes more difficult to take this decision when we have GC in hand because, as much as it helps to stay in US, it avoids us from leaving US too, and to wait for citizenship is another 5 years from that point, which could all take easily 6 years to the minimum from today. Thats why we wanted to make it easy on us, and do this now.

Looking back, would I re-do this GC process one more time - no, but am I happy to be a part of IV - you bet I am. Thats the bottom line.

Looking back, labor certification was the problem for lot of EB3 folks even though they were current at I485 stage. There was so much backlog (5 years or more) in certain states. While certain states could get the labor approved in a couple of months. People with older PD than yours could get greencards before Sept 2005. Smart guys changed their jobs and went to states where labor was quick. There was lack of awareness and easy availability of information as we have on IV now. Even now fortunate folks are changing jobs and filing under EB2 to significantly shorten their wait times. The whole Green card wait is a career killer for many and that is sad.

Between 2001- 2005 nobody did anything about the labor backlogs. The community was only anonymously browsing forums. There was lack of initiative and courage among the community. All people could do was look upto attorney or HR to do a miracle for them. I wish those folks between 2001-2005 did something like forming IV then. After IV was formed in Dec 2005 we focused our attention on Labor department to clear backlogs. Remember Backlog elimination centers? Folks today are just very fortunate that they can get Labor approved in a few months. I do not see the same amount of pain and desperation in the new people as I have seen in old timers. Many new filers still think that if their labor could come in few months, I1140 could come in another few months, their I485 should be coming in the mail very soon. It is only when they lose job, or their employer revokes their I140, or face problems in the process they start worrying about Greenecard, read more about what backlogs are and want to play an active part in IV.

It is quite childish to create a new id every time you want to say something negative. Your message may be simple and straight forward, but it lacks the integrity or any trust worthiness.

This thread has gone anywhere. It could be simply because of the lack of EB3 I members participation. There is a definite lack of support from the vested parties and a few are discrediting this solution from getting traction and to top it all, I don't see any rational explanation against this. All I see is uncivilized personal attacks, self gloating and people who love to have fun at the misery of others.

As I said before, I will go ahead and do research on what we can do about it and use my years of invested social capital to see if I can do something about it. Once I get some thing substantially done, I will come here for support.

For the "skillz" person, I personally enjoyed your rants. I have/had chances to know personally and professionally many Stanford graduates, I believe they are not as much as fun as you are. :)

    ============

I believe in talking simple and straight. Well, EB3 friends have every right to work for their benefit. Nothing wrong with that. EB2 people should therefore unite and protect their interests too. EB2 group should unite and lobby hard to ensure that the current equation EB1 > EB2 > EB3 is not disturbed. After all, everyone is selfish when the pins are down. EB2 friends, can we be proactive and protect our interests before it is too late? Nothing to get emotional about

    Solutions

Subsection (3) should be reworded to clarify its application to derivative beneficiaries as follows

    (3) RETENTION OF PRIORITY DATE- If the age of an alien is determined under paragraph (1) to be 21 years of age or older,

    (A) for the purposes of subsections (a)(4), the alien's petition shall automatically be converted to the appropriate category and the alien shall retain the original priority date issued upon receipt of the original petition, and
    (B) for the purposes of subsections (d), the petition on which the alien was a derivative beneficiary shall automatically be converted to a new petition with the appropriate category once their Parent has permanent resident status and the alien shall retain the original priority date issued upon receipt of the alien parents original petition. This is without prejudice to a Parents right to object to such converted petition.

This new division into (A) and (B) makes a more appropriate distinction between principal beneficiaries and derivative beneficiaries. (B) also clarifies a Parent who does not want to petition their over 21 unmarried son or daughter, is permitted to oppose the automatic conversion of the application.

In addition, after four and half years since its enactment, the USCIS has still failed to issue implementing rules and a private bill should be introduced requiring the USCIS to perform its statutory duty to provide rules.

If the new points system is implemented, INA, section 203(h), becomes redundant in relation to future applicants. In this case a new provision should be added permitting all derivative beneficiaries to be considered as a child regardless of when they age out and when the petition becomes current. This would be a temporary relief measure for any derivative beneficiary currently subject to the family-based petitions so they do not age out while the remaining petitions are being cleared.

Removal of Child Status Protection Act of 2002 (CSPA), section 8

Section 8 of the CSPA provides provisions preventing the retroactive application of the legislation. As a result many beneficiaries have to wait in excess of 30 years for an immigrant visa. Derivative beneficiaries that were subject to wait times and aged out cannot apply the benefits of the CSPA if their parents petition was processed before August 2002. This means they are forced to back of the line; after already having waited up to 20 years, they are forced to wait for another lengthy period up to 20 years in the F2B category.

Therefore, section 8 has to be repealed to enable retroactive applicability. It cannot be right that if these same people had not abided with US immigration laws and entered illegally, they would be able to get status to remain and work in the USA under the proposed Z visa. However, by abiding by the law, they are instead forced to wait outside the USA for over 30 years in total since the start of the original immigrant visa application because they were ejected out of one line due to aging out as a result of the prolonged wait times, only to be forced to the back of a new immigrant visa line.

    Dream Act

This is currently incorporated within the STRIVE Act (sections 621 et seq.) and presumably will be brought forward in the upcoming Bill subject to final agreement by the Senators. However, there is ambiguity as to whether children in the USA who enter legally benefit from its provisions. This has to be clarified to ensure it applies not only to children who entered the USA illegally, but also to those who entered legally, such as in derivative status on an E2 visa of their Parent. The ambiguity is made worse because the STRIVE Bill includes the Dream Act in subtitle B of Title VI Legalization of Undocumented Individuals. It is an absurd situation if legal nonimmigrant children are not given at least the same equal treatment as illegal children. The future Bill should incorporate the DREAM Act into a separate Title so does not give the appearance it applies to illegal migrant children only.

E2 Investors and Rep. Heather Wilsons Proposed E2 Nonimmigrant Investor Adjustment Act of 2007

We strongly reiterate our support for this proposed legislation and urge you to do same. However, we urge you to go further by removing the proposed 3,000 cap or, at the very least, increase the proposed 3,000 annual cap to a more reasonable number such as 20,000 and/or provide annual increases to meet market demand to avoid backlogs and to avoid having to revisit the issue in future. Aside from our own members, E2 investors provide billions of dollars of investment in the US economy and much needed employment. They should be provided with a pathway to permanent residency and citizenship for their dedication and commitment to this country. It is undoubtedly very odd that illegal immigrants are receiving a pathway to permanent residency whereas E2 investors are not. It sends a clear message that entering the USA illegally is preferable because it provides a path to citizenship, whereas entering legally and working hard, investing substantial amounts of capital and employing US citizens for the benefit of the US economy does not (unless you are the extremely rare exception that qualifies under the EB5 investment visa).

I heard the following on the southern california talk radio. They mention that there are some blogs that speculate on how and what the conference will compromise. I am searching for the blogs they mentioned, i will post the link if i find them or if it is relevant to work related immigration.

"The current compromise being negotiated (or idea being floated) is based on a phased induction of the 'amnesty' program. based on certain verifiable checks and balances on the border and employment verification issues that will satisfy the conservatives. They also mention that it will take 3-4 yeas to set up the infrastructure to handle the increased workload. The undocumented workers will be able to apply by 2009 or so" nothing was mentioned about H1 and EB related issues.
