Hi, Did somebody take advantage of the new rule of H1-H4 decoupling where one can use the time spent in H4 in H1? or can somebody confirm that this rule is in place and a law ? Please let me know.
my wife worked for 31/2 years on H1/L1 before changing status to H4. After 4 years on H4, she recently got a job and he H1 was approved in 2 days under premium processing. So the decoupling rule is effective.

Regarding my I-485 appln. status - I do remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.

If this is an admin area fix and USCIS is the main one whom we may need to convince, do we still need to contact/involve politicians in this.
Coming elections, and two different parties, this may give a different color to the whole problem, than solving the problem.

I am the Susan from www.expatsvoice.org and just so you know my husband passed away last year
He was the petitioner for my son who was to follow to join. We only heard son had aged out in Oct 2005 and was getting a court case ready in early 2006.
Sadly my husband became unwell in March 06, diagnosed terminal on 4th May and died 13th May 2006
Someone posted, there maybe only a few cases but the cost is huge from an emotional standpoint
If I win my court case this may result in others having benefit who were previously denied lets hope so and stand together on this.
The grief and deprression I have suffered is unbearable due to errors, delays and husbands death
The memo in cspa clearly says that the CSPA should be interpred expansively, to me that means common sense and compassion.
Until we get an amendment to CSPA I feel there will be so many more cases of hardship and termoil to come to notice

GC is moving target, looks like some drunkard wakes up one fine morning and randomly moves the priority date value/importance. I know those in such situation may be relatively less in number but I know many who are and repurcussions for this look horrible for people who have not made past this luck test. I was one of the unlucky ones :(. good luck to guys who have moved forward hope you still help rest of us still stuck.

date of birth, Mothers name, fathers name, place of birth. It does not have my name and i am from India. Is it ok.. or should i get one with name.
My PD is not current but i am getting ready with all the documents, just in case it gets current.
Get affidavits from your parents or relatives who aware of your birth and attach these affidavits along with your original DOB certificate.

US or in Timbaktu. So IMO, the biggest advantage of GC is getting back the money

And for those of you who think Social Security will run bankrupt....that will never happen,
or the US president will lose his job. The Govt will always fund SS even if it means
increasing a ballooning deficit.
Not only do you get SS but you also have to pay taxes to US irrespective of where you live for the rest of your life. So on a net it is still arguable depending on your long term residency plan. And my friend, Social Security is going away in the next 10 years. You think the USA can maintain this kind of a deficit for ever with people not willing to see an increase in taxes.

This is the same person senthil or whatever his id is, keeps on delivering sermons on how indians and indian consulting companies are responsible for whole GC mess.
My PD dates are current now but I still feel for the people who filed their applications in 2001 and 2002 and cannot get benifits because of BECs...
Ofcourse they will have last laugh at the end of the day...

I mailed my passport for renewal to CGI Houston a week before it expired and it came back with a new passport in 2 weeks. I was able to talk to two people. Its very hard to get them on the phone....but yet I kept trying.
The address on the form is kind of confusing. They do not tell in the on-line application that they are expecting an Indian address and a US address unless you print it and see for yourself.

It's better to apply for 485 after getting the H4 stamp. Once you leave the country it is considered abandoning the green card application. So you may have trouble getting a visa stamp. I may be wrong. So once you get your H4 stamp then you can come in with a valid H4. If you are planning to travel only in July why not file 485 and Advance parole then you can travel with Advance Parole as a backup. It's just my opinion.
My husband's I-140 will be approved in few days and our PD is current right now. Once the I-140 is approved we are planning to file for I-485 the sooner possible. The main reason is for me to apply or EAD so that I could work. You should also consider that I am travelling on July/august and of course I will require a visa appointment at the consulate to stamp my H-4.
My questions are:
1- Is it safe to apply (once the I-140 is approved) before leaving U.S. For I-485 and EAD together?
2- What documents are required to file for EAD besides what is already being sent with the I-485?
3- What are the potential problems in leaving the country in July with an I-485 (with or without EAD, please tell me in both cases) submitted, and having a visa appointment at the consulate abroad in August to renew my h4 that expires in NOv 2007? Should I wait and apply for I-485 or EAD until Sept 2007?
In short: Could anyone please advise regarding the risks of filing in June the I-485, travel in July, have a consulate appointment abroad in August to stamp the H-4 visa that expires in Nov 2007 ? Should I wait until I come back? Much appreciated any replies.

1) Fast-track GC process for Masters degree holders from US universities. This will be the least controversial, boost admissions (and money) flowing into universities, and clear up backlog in regular GC queue. Its a win-win and most senators, congressmen have voiced support for it already. We can get very good support from University lobbyists also (if they exist!!).
If this process removes those with US Masters from the existing queue and puts them in a queue with no visa number limit, this is an excellent proposal. This might even eliminate the entire backlog.

Whatever Lofgren asked to USCIS , IV should pass that information to the media , with whom we got contacts now.
