We may be missing the issue by this infighting (which is not useful to anyone)
I think any firm involved in unethical behavior (immigration / tax/ state laws/employment laws) perspective should get targeted by USCIS/ICE/DOL and mother of all DHS etc.
In my understanding following are the type of employees....
a) Full time employees of large and small Companies like Engineers/Pharmacist/Internal positions/...ex GE/Microsoft/Google/Wellpoint. These guys do not work for "Clients". Usually do not have bench. (there may be some exceptions but minimal unethical behavior is expected).
b) Full time employees who work for large (Big5 and more) and small CONSULTING firms and consult to other organization... They work for specific project at a "client". Get paid at all times when on project and and on bench. (minimal unlawful activity)
c) Full time employees of small mom and pop firms (small business/ grocery store/restaurants etc) Get paid a salary but a lot of perk (which are not on w2 in order to save taxes...and that is unethical behavior).
d) Employee (may be not full time) focused on work at "Client". They are not full time because they do not get paid when they are not on project. Usually smaller "consulting" firms (i would prefer to call them "contracting" firms) do this. There may be many many layers of contracting firms. Each is involved in some sort of unlawful activity.
I think USCIS should/will go after folks involved in unlawful activities like untaxed money paid...wrong skills listed etc etc etc......Lastly, Just because one was able to do this before does not mean it was legal...

please read my message you quoted. I wrote nothing in support of or aganst the letter. Nothing they (earlier posts) say is going to make the dates go back or forward. All the poor folks are trying to do is maybe vent out their frustration. What difference does this make to you? No action is going to be taken based on one letter. You are safe, please enjoy your current date status.
I can see the writing on the wall about where IV would be once most of Eb2 get their GC. It would almost stop existing.

I am not worried about my GC safety or lack thereof. Lets talk specifics - thats always been my position. I am also fully aware that nothing is going to happen in an arbitrary and knee jerk manner based on sympathetic letter requests.
However for argument sake lets assume something happens based on these letters. If a number is taken from EB2 to be given to EB3, I am well within my rights to express my opposition to that just like EB3 is well within their rights to vent their frustration.
Not mentioning EB2 in the letters is not going to result in numbers being created out of thin air. These numbers have to come from somewhere IF the total pie does not increase: read EB2.
As to your comment about IV existing or not - time will tell, but I dont try to hide the fact that beyond attending the Sept. rally, I am only an arm chair participant.

he is the only person who had this comeback. He said that is what everyone says until they are on their death bed.
now; why is this story relevant? How comfortable are you in arguing this. I remember a long time ago a person had this query; and he responded that he was on medical leave. USCIS came back and asked for verification with medical records. Others tried to get letters from their employers saying they had extended absences, etc. but employers won't give the letters because they think they will be on hook for payment of wages to you if they give such a letter.
It is not an easy thing to overcome or argue as one may think.

We should talk to the campaign officials of both Obama and John McCain. We should clearly articulate our case and lead this effort more vigorously with whoever that wins the election.

The following month, Dobbs featured ITT Industries, an engineering and manufacturing firm. One of the things he liked about ITT, he told readers, was that CEO Louis Giuliano "puts such a high premium on his employees, and their involvement in 'value creation.' A lot of CEOs view employees simply as fat to be cut in service to the bottom line or in pursuit of a better stock price. Louis is one CEO who knows better than that..." Is ITT on Dobbs' list of companies moving jobs overseas? By now, you know the answer.
And in February of this year, Dobbs focused on energy company Pinnacle West. After touting the company's "rapid growth," he told readers, "The second reason I like Pinnacle West is its model corporate governance." He went on to ask CEO William Post: "Last year, the Greater Phoenix Economic Council awarded you the Outstanding Regional Contribution award, recognizing a lasting contribution to regional economic development efforts. How important is it to you, as a corporate leader, to contribute to your region's economic development?"
Pinnacle West -- like Toro, Greenpoint, Boeing, Bank One, Washington Mutual, ITT Industries and Office Depot -- appears on Dobbs' list of companies that are "exporting America."
Dobbs is careful in his televised comments for CNN not to attack individual companies directly by name, and he's never called for viewers to boycott companies that outsource. But by posting their names on a website titled "Exporting America," and by making on-air declarations like, "U.S. multi-nationals are shipping jobs for only one reason...cheaper labor costs," Dobbs leave little doubt about how he wants his attitude toward the companies to be perceived by viewers.
Dobbs says the website was set up merely to fill a vacuum. In an email to Campaign Desk, he wrote: "We began compiling our list of companies outsourcing jobs overseas because the information was not available anywhere, and we wanted to know how widespread the practice is, and report it to our viewers. The Labor and Commerce departments, the Business Roundtable, and the U.S. Chamber of Commerce have never kept records of jobs lost to outsourcing. Our list of corporations now exceeds 800, and grows daily."
And he sees no contradiction in fingering outsourcers with one hand, while recommending the same companies as investment opportunities with the other: "[Y]ou seem to be suggesting that one cannot criticize corporate America without calling for its destruction," he told us. "Or because one believes a company to be well-managed that's its beyond criticism...Surely, you don't believe that your readers or my viewers are incapable of abhorring a business practice, and at the same time acknowledging the success of a corporation?" He makes a distinction, he said, between bad practices and those who practice them.
But Dobbs' newsletter doesn't just "acknowledge" successful corporation. He goes further, painting his featured companies as good corporate citizens -- and encourages readers to invest in them partly on that basis -- without mentioning that they conduct business practices that, by his own admission, he "detests."
Most of Dobbs's CNN viewers don't have access to the information in "Money Letter," his investment guide. So the larger public sees only one Lou Dobbs: the outspoken anti-outsourcing crusader. Dobbs is careful in his televised comments for CNN not to attack individual companies directly by name, and he's never called for viewers to boycott companies that outsource. But by posting their names on a website titled "Exporting America," and by making on-air declarations like, "U.S. multi-nationals are shipping jobs for only one reason...cheaper labor costs," Dobbs leave little doubt about how he wants his attitude toward the companies to be perceived by viewers.
Dobbs says the website was set up merely to fill a vacuum. In an email to Campaign Desk, he wrote: "We began compiling our list of companies outsourcing jobs overseas because the information was not available anywhere, and we wanted to know how widespread the practice is, and report it to our viewers. The Labor and Commerce departments, the Business Roundtable, and the U.S. Chamber of Commerce have never kept records of jobs lost to outsourcing. Our list of corporations now exceeds 800, and grows daily."
And he sees no contradiction in fingering outsourcers with one hand, while recommending the same companies as investment opportunities with the other: "[Y]ou seem to be suggesting that one cannot criticize corporate America without calling for its destruction," he told us. "Or because one believes a company to be well-managed that's its beyond criticism...Surely, you don't believe that your readers or my viewers are incapable of abhorring a business practice, and at the same time acknowledging the success of a corporation?" He makes a distinction, he said, between bad practices and those who practice them.
But Dobbs' newsletter doesn't just "acknowledge" successful corporation. He goes further, painting his featured companies as good corporate citizens -- and encourages readers to invest in them partly on that basis -- without mentioning that they conduct business practices that, by his own admission, he "detests."
Most of Dobbs's CNN viewers don't have access to the information in "Money Letter," his investment guide. So the larger public sees only one Lou Dobbs: the outspoken anti-outsourcing crusader. Whereas i agree with you that you can live good life anywhere, even with no house and no place to live you can live a good life.
But just because your friend got Grilled, shouldn't prevent you from taking risk. It is like, if somebody got run down by bus while crossing street, you would never cross that street.
That is not a good example. Like I said. everybody takes chances, some win and some don't.
Chances of loosing right now, is very slim, since everything is lost and if you still have a good healthy job, chances are you would have it, and if you have backup like double income, you are running in no probability zone.
After your i485 gets denied, I am assuming you can file MTR and wait for it. More senior members may throw light but I am guessing you would have 2-3 months time to leave the country.
On a complete side note, who gives a damn of overstaying if your GC is denied after 10 years of legal staying in US. Stay another year or so and setlle down stuff before you go home. Even better, stay as illegal in this country and join millions other, and chances are that you would get GC before other IV members :).

Armed with such data, they can decide for themselves who, if anyone, is trying to buy their congressional representatives.
A lot of political influence is at stake if such transformations proliferate. In last year's elections, 527s spent $143.2 million. The biggest outlays on the Democratic side came from the Service Employees International Union, Emily's List and America Votes, a coalition of liberal groups. On the Republican side, the big spenders were the Progress for America Voter Fund, the College Republican National Committee and the Presidential Coalition.
There are many reasons that 527s might want to alter their stripes. The main one has nothing to do with concealment: The Federal Election Commission has been cracking down on 527s, insisting they cannot explicitly press for the election or the defeat of candidates.

its embarrasing to see a journalist fall down the hole like that. I dont think he realizes that he works at CNN and not at Fox. Nobody else spins it along with him. Wolf Blitzer and the rest dont pay any attention to him. Even during the election results night the only thing he was asked to do was ask a couple of senators for their impression on how the results were looking.
The problem with Lou is that he goes on air every day and tells the American people that if they are having a miserable time or not saving enough money or their kids are not studying hard enough it is the fault of immigrants and corporations.
If there is a "perceived" class divide, it is because there are certain segments of the society that live beyond their means, dont save up for a rainy day and are not vested in their financial future. If you want your kid to go to college you have to be with them, talk to them and work through their issues with them. It is always easy to blame someone that is of a different color or of a different background for your problems but it is not the solution.

That's why we need to stop people from promoting Lou Dobbs. Remember, one swallow doen't make a summer.
Also remember: these channels have (or may have) an hidden agenda. Rather than pure news and opinion disseminating channels, they are jockeying to be a opinion influencing channel. I just do not understand this part, why would they provide something and ask us not to use it. It is like giving you a piece of cake and telling you not to eat it. This whole thing sucks, they are making it harder for people who live by the law of the land.
I think a lot of AC21 cases are getting rejected because of the revocation of I140, Companies don't want to keep the people on their list if he/she is not working, because they have to prove the ability to pay for all those people as well. so they are revoking the I140 for people who are not with them anyore to reduce number of people in their list with USCIS.

Lou Dobbs has a right to speak his mind. A lot of what he says is rhetoric but it is within his rights. I wouldn't want to associate IV with any Latino related immigration movement. Their objectives, issues and means are altogether different from ours.
We [should] care only about legal immigrants and not have even a whiff of supporting illegal immigration in any form and from any country. For a long time now, the word immigration has been expanded to mean Latino immigrants and only Wall Street Journal takes care to single out that immigration from countries like India is of a different hue (more knowledge based), than immigration from Mexico (more labor intensive).
Bottom line, aligning ourselves with the Latino agenda is bad policy and politics and a losing proposition.

Again where are you getting that 550K value for a house from . The houses that were 500K two years back are now 400 - 450K ( exclude the extremes ). Why the HOA - can't the house be a single family home like most of US .

Housing price correction has already happened in most of the good areas. If you think that they are going to go down 20% more that is never going to happen. People are not going to sell. They will just say put rather than take a 40% loss.
pandeyji, please dont jump to conclusion. The "kind" of house I want to live in is 550K now. I dont know how much was it 2 years back. I live in Seattle, where prices started to fall only late last year and this year when MSFT , Boeing and Starbucks announced layoffs.
I agree that there are some places now such as : NC, SC, FL, MI , OH, TX, MN etc are good places to buy. CA , OR, NV, AZ and WA have vast supply of inventories.
When I say I am expecting 20% correction, I am not speculating in blind. I have seen the data on zillow.com where they tell you last price the house was sold for, the date and current price. Zillow also tells you what is their estimate you should offer in current market conditions and how much correction, upward or downward have they seen in last 3 months.
Now for eg: I see houses from 1999 where they sold for 250-300 K and owners of the same property now expect 550-600K in 2009.
Now if I do a rent vs buy, I must offer this guy 400K-420K (max) for it to be profitable for me in 5-7 years against the current rent. Also majority of the houses have HOAs here in WA metro areas. Some are high and some are low.
Again if I have any realistic chance for this guy to take my offer in good faith, he must bring down the cost to 450K. Then 400-420K is a doable deal.
If the seller is serious, there is no reason why he will not accept a 420K offer because there is abundant oversupply in the market. He can hold out for 2 years but a distressed or needful seller will have to sell home for that price because he might get only 1-2 offers in a month or few months.
Even in my own community, people are expecting 350 K for a condo with 280 HOA, do you think, I can offer them 270K? Only then the rent/buy will make sense for me in next 5 years (and to be honest I dont plan to live in a town home for 30 years).
I have given you enough numbers, do the math, lets not bring emotional sentiment into this.
Taxes - well I was not saying you get the whole money back but are taxes the only reason one should not buy a house ?
Housing price correction has already happened in most of the good areas. If you think that they are going to go down 20% more that is never going to happen. People are not going to sell. They will just say put rather than take a 40% loss.
pandeyji, please dont jump to conclusion. The "kind" of house I want to live in is 550K now. I dont know how much was it 2 years back. I live in Seattle, where prices started to fall only late last year and this year when MSFT , Boeing and Starbucks announced layoffs.
